Unlike matters heard before Municipal Courts, Crimes are different from offenses and are heard at the County Courthouse, known as the Superior Court. Criminal Defendants will have to appear before a Superior Court Judge at the Sussex County Courthouse if you are charged with a crime in one of Sussex County’s municipalities. Crimes are graded by degrees and can be a first degree, second degree, third degree or fourth degree.

The Sussex County Prosecutor’s Office is usually the prosecuting agency responsible for the prosecutions of all crimes in Sussex County. There are times, however, when the New Jersey Attorney General’s office is the prosecuting agency.
